This is the Last Will and Testament of me John Fry of Butchers Cross in the Parish of Mayfield in the County of Sussex Blacksmith touching the disposition of such temporal estate as it hath pleased Almighty God of his Goodness to bestow upon me as follows that is to say first I give and bequeath unto my dear Wife Mary such of my household goods and furniture as she may think proper

[the first line is unreadable] the sum of ten pounds to be [?] after my decease to her own use and benefit also I give and bequeath unto my son Richard Fry the sum of four hundred and twenty pounds of Sterling English money upon this trust and confidence nevertheless that he my said son Richard Fry his Executors or administrators do and shall as soon as conveniently may be after my decease place out and invest or consume the said sum of four hundred and twenty pounds in his or their name or names upon Government or other good and sufficient security or securities and from time to time to call in and place out and invest the same again upon securities of the like nature as he or they in his or their discretion shall think proper and to pay and apply the interest dividends income and proceed there of as the same shall from time to time become due and [?] unto the hands of my said Wife Mary or permit and suffer her to receive the same for and during the term of her natural life and from and after her decease then upon further trust that he my said son Richard Fry his Executors administrators do and shall call in the said principal sum of four hundred and twenty pounds and pay divide and distribute this same unto and equally between and among my three sons (namely) John Fry Edward Fry and the said Richard Fry share and share alike to their several and respective use and uses Subject nevertheless to the detention of my said son Edward’s share at interest in manner as hereinafter mentioned Also I give and bequeath the three forth parts or shares of all the rest and residue of my Ready Money and Securities for money unto my said three sons John Fry Edward Fry and the said Richard Fry equally to be divided between them share and share alike to their severall and respective use and uses Subject to the detention of Edward’s share as afore said and I give and bequeath the remaining or other forth part of the said residue of my said Ready money and securities for money to the several persons and in the shares and proportions following (that is to say) two tenth parts or one fifth part there of unto Richard Jarvis Fry natural son of my Daughter Mary Jarvis deceased / to his own proper use and benefit and the remaining eight tenth parts or four fifth parts there of unto my eight Grandchildren Robert, Mary, John, Fanny, Edward, Elizabeth, Martha and Harriett / the other Sons and Daughters of my said Daughter Mary Jarvis deceased / equally to be divided between them share and share alike to their several and respective use and uses Also I do hereby direct and declare that my said Wife Mary shall have the liberty and privilege of residing in the Washhouse Chamber of my [?] dwelling house rent free for the term of her life and subject thereto I give devise and bequeath unto my said son Richard Fry all that my messuage or tenement with the outbuildings Gardens Land Hereditaments appnrts thereto belonging and also all that my Blacksmiths shop with the appnrts situate being and being at or near Butchers Cross in the parish of Mayfield aforesaid and all other my Real Estate whatsoever and wheresoever and also all the Rest and Residue of my household goods chattels effects and personal estate whatsoever and wheresoever to hold the same to him my said son Richard Fry his Heirs Executors auditors and Assigus for ever but subject and chargeable …

[three quarters of the first line is unreadable] mentioned (that is to say) I do hereby order and direct that as soon as conveniently may be after my decease an exact and fair valuation and appraisement of as well my said Messuage tenement Blacksmiths Shop Outbuildings Gardens Land Hereditaments and real estate as of the said residue of my household Goods Chattels effects and personal estate Shall be made by two indifferent persons one to be chosen by my said son Richard Fry and the other by my said sons John Fry and Edward Fry and in case of the disagreement of such two appointed persons then by such one impartial person as those two shall for that purpose appoint and that two fourth or one half of the amount of such valuation and appraisement together with interest there from the time of my decease shall be forthwith paid by my said Son Richard Fry unto and equally between my said sons John Fry and Edward Fry share and share alike to their several and respective use and uses and that one other fourth of the amount of such valuation or appraisement together with interest of there from the time of my decease shall [?] paid by my said son Richard Fry to the several persons and in the shares and proportions following (that is to say) two fourth parts or one fifth part thereof unto the said Richard Jarvis Fry to his own proper use and Benefit and the remaining eight tenth or four fifth parts thereof unto my aforesaid eight Grandchildren Robert, Mary, John, Fanny, Edward, Elizabeth, Martha and Harriett the sons and daughters of my said Daughter Mary Jarvis do [?] equally to be divided between them share and share alike to their subject my said hereditament to an Real estate and the residue of my said personal estate with the payment there of in manner afore said accordingly provided nevertheless and my will and meaning is and I do here by order and direct that my said son Richard Fry shall hold as well my son Edwards share therein as also the other monies by me hereinbefore bequeathed to my said son Edward at interest subject to the payment of such principal monies with interest from time to time accruing on the money remaining in hand half yearly by twenty equal instalments within ten years from the time of my decease the first payment or instalment to be made at the end of the six months from the time of my Wife’s decease as to his share of the said four hundred and twenty pounds and from the time of my decease as to the said other monies and I do by this my will direct and declare that the provisions by me here in before made and given to and for the benefit of my said wife Mary are and are intended to be in full Bar and all Power and Thirds and Rights and title to Power and thirds which she may claim of in or to any of my messuages Lands hereditaments and Real Estate and I direct that my said wife do and shall within the space of Six Calandar Months next after my decease execute a release of such power or thirds to my said son Richard Fry and his heirs or on her refusal so to do it is my will and I do hereby direct and declare that the provisions by me here in before made to or in favour of my said wife shall cease and become void to all intents and purposes whatsoever and where as I have already advanced and lent and hereafter may advance and lent to my three sons aforesaid or some or one of their of certain sums of money at different times for which I have heretofore taken and may hereafter take no proper security but I have charged and do intend to charge the amount of the several sums in advance and to be advanced to the amount of my said three sons respectively under my own hand writing in my book of account kept for that and other purposes Roro I do declare that my said sons respectively shall be accountable and stand indebted to my estate at the time of my decease for the several sums of money which shall then appear by my said book of account under my hand writing to be charged against them respectively and due and owing to me in manner as aforesaid And lastly I do hereby make nominate constitute and appoint my said two sons John Fry and Richard Fry joint Executors of this my last Will and testament hereby revoking all former wills by me made and declaring this only to be my last will and testament in witness whereof the said John Fry the testator have to the three first sheets of this my last will and testament (contained in four sheets of paper) set my hand and to this fourth and last sheet thereof my hand and seal also this eighth day of June one thousand eight hundred and sixteen John Fry ø signed sealed published and declared by the said John Fry the testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have here unto submitted our names as witnesses
